KFC Rotten Chicken Lawsuit: Former Manager Says He Was Forced To Serve Green, Expired Chicken

The term "green chicken" is pretty stomach-turning, especially when you learn it might have been purposely served to customers at an Oregon KFC, according to a lawsuit filed this week.

The Consumerist summarizes the lawsuit: "A former manager at a KFC eatery in Oregon alleges that the owner of his franchise not only ordered employees to serve expired chicken, but also that employees who refused to do so were fired."

According to the lawsuit [pdf], KFC receives boxed shipments of fresh -- not frozen -- chicken. The boxes indicate a "kill date" of when the birds were slaughtered and processed. Employees are instructed to not serve chicken 12 days past the "kill date."

The plaintiff, a former manager, explains in the suit that "chicken not served within 12 days of its kill date developed a noticeably foul, rotten smell. In addition, expired chicken changed color from white to light green and the blood on the chicken began to noticeably thicken and coagulate."

But when the plaintiff found greenish chicken and approached the owner saying it should be thrown out, the owner instead instructed him to cook and serve the chicken immediately. Similar incidents continued, according to the suit, such as the plaintiff receiving a text message from the owner to serve rotten produce.

The manager and owner's relationship soured after these instances, especially after another manager left in protest over serving rotten chicken. The manager/plaintiff was eventually fired for "arguing with leadership," and "not creating an environment of team work with leadership and owner."

Though it's impossible to know what really went down between the owner and manager, we're not keen to sample the fare from the Seaside KFC to find out who is telling the truth. - THP

How We Nearly Lost 'Discovery'

Now that Discovery is safely delivered to the Smithsonian, I think I can tell the story of how we nearly lost her in July of 2005, and how well intentioned, highly motivated, hard working, smart people can miss the most obvious.

It’s tough to know people who have died. Many of us knew the astronauts on Challenger and Columbia well. We had met with them daily, we had visited in their homes, we knew their families, their children. It is not an easy thing to lose a colleague; especially one who entrusted their safety to you. So don’t question whether we were motivated to prevent another loss.

Discovery was the shuttle return to flight vehicle after the Challenger was lost; two and a half years were spent from January 28, 1986 until Discovery flew in September 1988. Many improvements were made which resulted in a safe space flight.

Is Japan's Mt. Fuji Ready to Erupt?

Reports are appearing about unrest and signs of a possible awakening of Mt Fuji volcano in Japan. According to a report which includes an unclear photo of the area, a row of new craters, the largest 50 m in diameter, has appeared on the eastern flank of the volcano at 2200 m elevation. Steam was observed erupting from these vents. The observation joins other signs suggesting a gradual reawakening: A swarm of earthquakes including 4 of magnitude 5 have occurred northeast of Mt Fuji on and after 28 January. An earlier 6.4M quake occurred under the volcano on 15 March 2011. The report also mentions increased activity from a fumarole vent at 1500 m elevation and hot spring areas at the eastern flank observed since 2003. These locations seem to be aligned geographically, and are probably connected. Dr. Masaaki Kimura of Ryukyu University is quoted to admit that there is an increased risk of an eruption on the eastern flank and that the status of the volcano should be closely monitored. Mt. Is This Justice?

I spent 22 years on death row for a murder I didn't commit. Now, even though I've been proven innocent and freed, the state of Texas still treats me like a convicted killer.

In 1978, I was sentenced to death for the rape and murder of a 21-year-old woman. After decades in prison and almost 4 separate trials, I never stopped fighting to prove my innocence. And in 1999, DNA evidence proved what I had said all along: I didn't commit that crime.

I was finally released from prison, but nearly 13 years later, Texas won't exonerate me, so I'm still on the books as a murderer. This makes it nearly impossible for me to sign a lease or get a job. Why am I still paying for a crime I didn't commit?

The only person who can officially pardon me is Governor Rick Perry of Texas, and he takes his cues from the Texas Board of Pardons and Paroles. I started a petition on Change.org asking the Board of Pardons and Paroles to recommend me for a full pardon -- will you sign it?

Despite an Appellate ruling throwing out my second conviction with findings that "Police and prosecutorial misconduct has tainted this entire matter from the outset," I feel that the Smith County District Attorney's Office was more interested in saving face than serving justice.

On the eve of my fourth trial, prosecutors offered a plea-bargain: plead no-contest with no admission of guilt, and go free. I had been offered plea-bargains before and turned them down because of my innocence. But by this point, I was facing the possibility of another death sentence and my whole life came apart -- my only brother had been murdered, my Dad had died of cancer, and my mother abandoned me. I took the offer and walked out of the courtroom.

Two months later, DNA evidence proved my innocence.

But because of that no-contest plea, I need Governor Perry to pardon me in order to be considered an innocent man. My time in prison still haunts me -- I have severe Post Traumatic Stress Disorder stemming from being raped there. I just want to be free of this terrible nightmare, but as long as I am on the books as a murderer, part of me feels like I will always be in jail.

The Texas legal system ignored and abused me for decades. But they won't be able to ignore me any longer if thousands of you stand beside me.
